Who's at Fault After a Car Accident in The Bronx?

Just about anyone involved in an accident can be considered at fault. This includes:

  • The other driver
  • An employer
  • A pedestrian
  • A municipality

New York uses a rule known as pure comparative fault that allows a claimant to recover damages even if they were partially responsible for causing the accident.

Our car accident lawyers can help you determine who’s at fault through the use of:

  • Accident reconstructions experts
  • Police reports
  • Witness reports
  • Security footage
  • Dash cam footage

However, New York uses a rule known as contributory negligence to determine how much fault someone bears for the accident. This rule can affect how much you may receive in damages if the evidence shows that you contributed to the accident.

Suing a Government Entity for Your Car Accident in New York

In the event of an accident involving a government entity in New York, you can still sue, provided that you follow the laws governing claim and/or lawsuit filing.

You have 90 days to file a formal claim and one year to file a suit against a city, county, or the State of New York. You also have 90 days to send a notice of intent to file against the government entity if you’re unable to get a final claim amount because medical treatment hasn’t been completed.

What Types of Compensation Can I Recover After a Car Accident with Injuries?

You can recover economic and non-economic compensation after a car accident in The Bronx. Economic losses can include:

  • Payment for medical bills
  • Income you lost while unable to work
  • Any lost earning potential from disability
  • Financial losses stemming from a wrongful death

How Long Do I Have to File a Lawsuit After a Car Accident in The Bronx?

According to the New York personal injury statute of limitations, you have three years from the date of the accident to file a lawsuit after a car accident in The Bronx.

While there may be some exceptions to this deadline, you will still want to work as quickly as possible after the crash. If you miss the statute of limitations, you may lose your opportunity to recover compensation at all. Our car accident lawyers in The Bronx, NY, can explain the specific deadlines that apply to your case and help make sure you don’t miss them.

Do I Need to File a Motorist Accident Report After a Car Accident?

Section 605 of the NY State Vehicle and Traffic Law requires drivers to file a motorist accident report within 10 days of the accident if someone is injured or killed or there is property damage totaling more than $1,000 to the property of one person.

Filing a motorist accident report helps you as an accident victim when you go to file an insurance claim or lawsuit. This report can be used as direct evidence that the accident resulted in bodily and property damage. Insurers cannot ignore the information in the claim, and a court of law considers this report an appropriate record for the purpose of evidence.

Can New York's Insurance and "Serious Injury" Laws Affect my Ability to Sue for Damages?

The “serious injury” and personal injury protection insurance laws can affect your ability to sue for damages to a point. Because New York State has a no-fault insurance system, you first have to go through your insurance company to get financial reimbursement.

In the event that you suffered injuries stemming from the accident, your claim invokes personal injury protection (PIP) coverage.

PIP covers up to $50,000 in lost earnings, medical and health expenses, and other reasonable expenses that are related to the injury. If you have a serious injury with costs that exceed $50,000 in damages, you may be able to file suit against the at-fault driver for economic and non-economic recovery.

The PIP and “serious injury” laws are complex and designed to minimize the potential for a personal injury lawsuit after a car accident. Your best course of action is to consult with a lawyer about your Bronx car accident to make sure you’ve exhausted all avenues for receiving the maximum amount of compensation.

Common Causes of Bronx Car Accidents

Some kinds of accidents are more common than others in the Bronx due to geography, common types of vehicles driven, the willingness to drive impaired or distracted, and poor judgment. The most common causes include:
