Proving Liability in a Newark Personal Injury Case

Determining liability in a New Jersey personal injury case really involves an analysis of the circumstances under which it occurred. A lawsuit is comprised of two different parts. One, there has to be injuries; somebody has to have actually gotten hurt from somebody else’s misconduct. Then, the other part of it is the misconduct has to directly cause those very injuries.

So, for example, if somebody does something on the road that is reckless, like cuts you off, but ultimately there is no collision of the cars and everybody continues on without any kind of an incident or impact, then although the conduct may have been illegal and improper, and if there had been any injuries, that person would be liable for those injuries. Because they were driving recklessly, the fact that it happened doesn’t automatically entitle you to sue. There needs to be injuries that are directly related to the bad conduct.

It’s really important to be able to speak to a lawyer about what types of conduct causing specific types of injuries could a person or a corporation be held accountable for.

There are four elements required to prove negligence. These include:

Duty of Care

A duty of care arises when the law recognizes a relationship between two parties. Due to the nature of this relationship, one party has an obligation to exercise reasonable care that another person in a similar situation would exercise. 

For example, drivers on public roadways have a responsibility or duty of care to others on the roads.

Breach of Duty

A breach of duty occurs when the defendant does or fails to do something that an average person would do in a similar circumstance. For example, if a driver fails to signal before merging lanes, they might have breached their duty of care.

Causation

Causation requires a plaintiff to show that the defendant’s breach of duty was the cause of the plaintiff’s injury and losses.

Proximate Cause

Proximate cause means that the injury could be reasonably expected to occur from the breach of duty. It also means that the injury was directly caused by the behavior of the at-fault party.

Actual Damages

Actual damages refer to proof of the injury and its resulting financial harm, such as medical bills or lost wages.

I have, sadly, seen too many incidences where somebody speaks to an insurance adjuster soon after an accident. They decide to take what they perceive as quick money, and then it turns out that they have serious injuries that develop, called latent injuries or what have you.

By ‘what have you’, I mean that today, I suffer from back pain and from whiplash. The next day it continues to get worse; I go for treatment and I try to use conservative measures – pain management, chiropractic, physical therapy – and the next thing I know, nothing’s working and I have to get a fusion surgery. Well, at that point, if you’ve signed a release agreeing to accept a small amount of money from the insurance company right off the bat, you cannot come back to the insurance company and ask for more, simply because your injuries just got tremendously worse.

That’s why it is really important to speak to a lawyer to make sure that they fully evaluate your case and determine whether you’re getting a fair shake. Most of the time, what you’ll learn is that speaking to a lawyer can increase the amount of compensation that you receive tremendously.
