In this video, I’m going to talk about what negligence law is and how it applies to property owners in New York.
As a property owner, you have a responsibility to maintain your property in a reasonably safe condition. This means that you need to take steps to prevent injuries from happening on your property. If you fail to do so and someone gets hurt, you could be held liable for their injuries.
There are a number of statutory duties that property owners have towards visitors and tenants. These duties include keeping the property free of hazards, repairing any dangerous conditions, and providing adequate security. If you violate any of these duties and someone gets hurt, you could be sued for negligence.
To win a negligence case, the plaintiff must prove that the defendant owed them a duty of care, that the defendant breached that duty, and that the breach of duty caused the plaintiff’s injuries. If the plaintiff can prove all of these elements, then they may be entitled to compensation for their damages.
