New Jersey Actos Attorney

Pharmaceutical drugs treat illnesses in patients, but, when drug makers fail to ensure its products are safe, injury and illness are often the results. Takeda Pharmaceuticals developed Actos to treat type 2 diabetes. Unfortunately, many patients experienced serious adverse effects from the drug. If Actos injured you or a loved one, a New Jersey Actos attorney at Meirowitz & Wasserberg, LLP, has the experience you need to seek the compensation you deserve in the Garden State.

What Is Actos?

The FDA approved Actos, also known by the generic name pioglitazone, in 1999 for the treatment of type 2 diabetes. The drug works by lowering the amount of sugar in the bloodstream by making tissues more sensitive to insulin. Doctors prescribed the drug for patients suffering from type 2 diabetes, especially in cases where other medications had failed to achieve glycemic control.

Problems with Actos

All medications come with some side effects, and for a small number of patients, those side effects may be severe and require the patient to stop taking the medication. However, some patients taking Actos experienced side effects that were so severe, they were dangerous to the patient’s health.

The FDA determined in 2007 that a class of drugs including Actos may cause congestive heart failure for some patients. Some patients taking Actos begin to experience signs of heart failure, including excessive, rapid weight gain; difficult or labored breathing; or edema, swelling from excess fluid trapped in the body’s tissues. The FDA issued a “black box warning,” the most serious warning it mandates on pharmaceutical drug labels, advising patients of the serious risks of taking Actos, especially if they have a history of heart disease or may be at risk for heart failure.

In addition to the risk of congestive heart failure, in 2011 the FDA announced that taking Actos for more than a year was associated with an increased risk of bladder cancer. This action was taken after a 10-year safety review noted those with the highest overall dose of Actos had a higher risk of developing bladder cancer. The FDA warned that patients with active bladder cancer or a history of bladder cancer should not use Actos. Patients taking Actos who showed symptoms of bladder cancer should consult their doctors immediately. If you or a loved one has experienced any health complications and you believe Actos is to blame, speak with a qualified New Jersey personal injury lawyer experienced in these types of claims.

Product Liability Claim Against Takeda Pharmaceuticals

Product manufacturers have a duty to ensure the products they make and sell are safe for the consumer. In a product liability case, you must show the product suffered from a design defect, warning defect, or manufacturing defect.

The common claim against Actos is that the manufacturer failed to properly warn patients of the dangers of taking Actos. Plaintiffs have argued that Takeda Pharmaceuticals was aware of the danger of bladder cancer well before the FDA announced the warning in 2011. However, Takeda continued to sell the product to patients without any warning of the potential for problems for patients with bladder cancer or a history of bladder cancer.

Compensation for Actos Victims

Patients suffering an injury due to taking Actos have the right to seek compensation for medical expenses, lost wages, and other expenses related to their injury. Medical expenses may include hospital and doctor bills and the cost of any prescription medication needed. Lost wages include not only wages lost due to time missed from work, but diminished earning capacity because of your injury. Consult a knowledgeable New Jersey Actos attorney to learn more about potential damages.
