Is it common for someone who is on workers' compensation and really injured to also be able to get other benefits, like Social Security, SSDI

"If you're over 50, the same injury that someone who's 20 can recover from and get back to work or move on with their life can be career-ending at 50 or 55. So, getting them the full range of benefits they could qualify for is really important. This could include Social Security disability, a disability pension for some state workers, or long-term disability through certain unions or employers "

Who Qualifies for Workers' Compensation on Long Island?

Nearly all employers in New York State are required to carry workers’ compensation insurance for their employees. This coverage applies to most employees on Long Island, including full-time, part-time, temporary, and seasonal employees. In certain situations, coverage may also extend to day laborers and specific categories of volunteers.

Workers’ compensation is a no-fault system. That means you don’t have to prove that your employer’s negligence caused the incident to receive workers’ comp benefits in New York.

To qualify for workers’ compensation, your injury or illness must have occurred while you were performing your job duties. For example, you may have fallen off a ladder while making roof repairs, developed a repetitive strain injury from working on a computer, or suffered respiratory problems from toxic chemical exposure on the job.

What Benefits Can Injured Workers Receive?

If you’re hurt on the job on Long Island, workers’ compensation can provide financial support while you recover. The benefits available depend on the nature and severity of your injury.

Here’s what you may be entitled to:

  • Medical expenses: Workers’ comp covers all necessary healthcare related to your work injury, including doctor visits, surgery, medication, and assistive devices.
  • Lost wages: You may be entitled to wage replacement if your injury keeps you out of work for more than seven days. This payment is about two-thirds of your average weekly pay, up to the state’s maximum weekly benefit amount.
  • Permanent disability: If you cannot return to your usual job because of your injury, you may receive more extensive compensation for your lost wages. Your compensation will depend largely on your disability class, such as temporary total disability, temporary partial disability, permanent total disability, and permanent partial disability.
  • Survivor benefits: If a worker dies from a job-related injury or illness, their surviving spouse and minor children may be eligible to receive survivor benefits. These include payment for funeral expenses and weekly cash benefits equal to two-thirds of the deceased’s average weekly wage for the prior year.

What To Do if Your Workers' Comp Claim Is Denied

You don’t have to give up after a denied workers’ comp claim on Long Island. You have the right to appeal, and many denials are successfully overturned with the proper evidence and representation.

1. Contact an Attorney

A workers’ compensation attorney on Long Island can quickly identify why your claim was denied and guide you through your next steps. Our consultations are always free.

2. Understand the Reason for Denial

With your lawyer’s help, review the denial letter to understand why your claim was rejected. Common reasons include missed deadlines, lack of medical evidence, or disputes over whether the injury was work-related. Knowing this reason allows you and your attorney to gather the right supporting evidence.

3. Prepare for a Hearing

The insurance company must notify the Workers’ Compensation Board when it denies a claim. The Board will schedule a hearing, where a judge will listen to arguments from both sides, review the evidence, and decide whether to approve or deny your claim. 4. File an Appeal if Necessary

If the judge denies your claim, you have 30 days to appeal to the Workers’ Compensation Board. A panel of three Board members may agree with, modify, or reverse the decision. If the decision isn’t unanimous, you can request a review by the full Board.

5. Pursue Higher-Level Appeals

If you remain unsatisfied after the Board’s review, you may appeal your case to the Appellate Division of the New York Supreme Court. If needed, a final appeal can be made to the New York Court of Appeals. Your attorney can advise you on whether further appeals are appropriate and guide you through each step.
