Filing a Personal Injury Claim in New York: What You Need to Know

New York personal injury law gives you important rights after an injury, but strict deadlines and notice rules control how and when you can file a claim. You protect your case when you understand how statutes of limitations, government notice rules and crash reporting requirements work.

New York's Statute of Limitations

New York has deadlines for filing an injury claim called statutes of limitations. For most personal injury claims, the deadline is three years from the date of injury, and two years for wrongful death cases. For minors, the statute of limitations is three years from the date they turn 18.

If you’re suing the City of New York, MTA or other government entities, you have 90 days to give them notice of your claim. This is a critical NYC-specific rule.

Motor Vehicle Accident Report Requirement

Under Section 605 of New York Vehicle and Traffic Law, you’re required to file a motor vehicle accident report within 10 days if there are injuries, death or property damage over $1,000. If you fail to do this, the state may suspend your driving privileges.
