North Carolina Mesothelioma Lawyer
Mesothelioma is a rare and aggressive cancer that develops in the mesothelium—the membrane surrounding internal organs. The only confirmed cause of mesothelioma is asbestos exposure. Symptoms may not develop for years or even decades, and mesothelioma victims may not even be aware they were ever exposed to asbestos before their diagnosis.

Mesothelioma is a very, very rare form of cancer of the lining of your lung. We have a very amazing, saran wrap-like material that covers our lungs. It allows us, when we breathe, for our chest cavity to expand and contract without causing injury to the organs. It’s really quite incredible. And, unfortunately, what happens in the case of somebody with Mesothelioma is that the cancer develops in that saran wrap-like lining. It’s a very thin layer of cells, and so what often happens is the cells develop into tumors, and those tumors become diffused and spread over the mesothelial lining of the lung and cause, unfortunately, very difficult breathing problems for people that are diagnosed with Mesothelioma. It is, sadly, an incurable form of cancer. It is treatable, but it is incurable. One of the things that are really unique about Mesothelioma is that it’s called a ‘signature disease’. And the reason why it’s called the signature disease is because there’s only one known cause that the weight of the scientific evidence supports, and that is exposure to asbestos. So when somebody is diagnosed with Mesothwlioma, the question is not whether they were exposed to asbestos in their lifetime; it’s how and when.
People recently diagnosed with mesothelioma often feel that fighting for compensation while battling cancer is too great of an ordeal to face alone. A knowledgeable mesothelioma attorney can alleviate the pressure of seeking legal restitution.Â
If you developed mesothelioma after asbestos exposure in North Carolina, you can rely on Meirowitz & Wasserberg to protect your best interests. We do the legal work so you can focus on what matters—your health, family, and livelihood.

Don't Know What Caused Your Mesothelioma? We'll Investigate.
Mesothelioma is an insidious disease that often takes decades to develop. As a result, you may not know the circumstances that caused your mesothelioma or when your original asbestos exposure occurred.Â
Secondary Asbestos Exposure
At Meirowitz & Wasserberg, we investigate thoroughly to help our clients discover the root cause of their mesothelioma diagnosis. One investigation our office handled was the case of an Illinois woman who was diagnosed with mesothelioma after living for years as a homemaker with no known risk for asbestos exposure. Our probe revealed that she had washed her husband’s work clothes every day when he returned from his job at a Chicago industrial plant. Further research uncovered previous discovery of asbestos at the plant.
As this story reveals, asbestos exposure can occur unknowingly through secondary exposure. For example, inhaling or ingesting asbestos carried home on a family member’s clothing may cause mesothelioma even though the patient never directly worked with handled asbestos.
Occupational Asbestos Exposure
Some North Carolina-specific jobs and locations pose a high risk of asbestos exposure. Naturally occurring asbestos is common in the state’s mountainous western region, where mine workers have been exposed to asbestos for decades. North Carolina is also home to numerous military bases, many built during the 20th century when asbestos use peaked. Thus, military veterans have likely been exposed to asbestos in North Carolina.
If you develop mesothelioma, consider potential sources of asbestos exposure you may have previously experienced. Unfortunately, you may find that your mesothelioma is rooted in seemingly innocuous circumstances that prompted asbestos exposure without your knowledge.
Fighting for Compensation After a Mesothelioma Diagnosis in NC
If you’ve been exposed to asbestos and developed mesothelioma, you may be eligible for compensation for lost wages, medical expenses, pain and suffering, and other losses caused by your illness. Filing a mesothelioma claim in court is often your best option for receiving the restitution you deserve.
Filing a North Carolina mesothelioma claim can be a complicated process. It’s important to seek legal counsel from a knowledgeable North Carolina mesothelioma lawyer before filing your claim.Â
How To File Your Mesothelioma Claim
First, you must have an existing mesothelioma diagnosis from a licensed medical professional to be eligible to file a mesothelioma claim.
After receiving a diagnosis, you should promptly contact an attorney. Look for a lawyer with extensive knowledge of mesothelioma cases and a proven track record of success.
An attorney can identify those responsible for your asbestos exposure. It can be difficult to know who was responsible for your initial asbestos exposure. A mesothelioma attorney can work with you to determine who is at fault.
Next, your lawyer will investigate and gather evidence. An attorney can investigate your case for critical evidence, such as employment records, medical reports, and proof the defendant was responsible for your asbestos exposure.
Your attorney will then file your claim with the appropriate court and ensure you meet all filing deadlines.
Finally, your attorney will negotiate your mesothelioma settlement. We work hard to win justice for our clients. We’ll negotiate with the opposition, and if they don’t agree to an offer that fully compensates you for the harm, we’ll fight them in court.
Notable Mesothelioma Settlements for Our Clients
Our award-winning attorneys have secured multimillion-dollar mesothelioma settlements for our clients. Some of the settlements we’re most proud of include:
- $5.1 million for a Navy veteran who worked as a maintenance mechanic and contracted mesothelioma from asbestos exposure
- $4 million for a sugar mill mechanic and lab equipment engineer who developed mesothelioma from asbestos exposure.Â
- $3.15 million for a house painter diagnosed with mesothelioma after being exposed to asbestos in construction materials while on the job
The diligent attorneys at Meirowitz & Wasserberg gladly take on difficult cases other firms won’t touch.
Types of Mesothelioma Claims We Handle in North Carolina
There is no one-size-fits-all approach to taking on a mesothelioma lawsuit. Our office handles a wide variety of possible mesothelioma claims involving many types of harm suffered by asbestos-exposure victims. These include:
Personal Injury Claims
Asbestos exposure victims might be eligible to file personal injury claims against those parties responsible for their asbestos exposure and seek compensation for their losses.
Survival Claims
Survival claims are claims that “survive” the plaintiff if the plaintiff dies after bringing a personal injury lawsuit.Â
Unlike wrongful death claims, survival claims are not designed to compensate the plaintiff’s family. Survival claims seek the personal injury damages the plaintiff would have won if they had not died.Â
Wrongful Death Claims
In a wrongful death claim, certain surviving family members can receive compensation for the death of their loved one from another party’s actions or omissions. If your loved one has died from mesothelioma or another asbestos-related disease, you may be entitled to compensation from those responsible for your loved one’s asbestos exposure.Â
Wrongful death damages may include funeral and burial costs, pain and suffering, loss of the decedent’s income, and other losses. In North Carolina, only a named or court-appointed personal representative may bring a wrongful death claim.
VA Claims
The Department of Veterans Affairs provides disability benefits to veterans with qualifying service-connected conditions. Veterans who were not dishonorably discharged and have developed mesothelioma from service-related asbestos exposure are eligible to file claims for VA benefits.
VA benefits may include monthly disability payments, free health care, and health care benefits for veterans’ families.Â
Surviving spouses and children of veterans who died of mesothelioma may also be eligible for monthly financial benefits called Dependency and Indemnity Compensation.
Workers' Compensation Claims
Workers’ compensation claims provide partial wage replacement, free medical care, and death benefits to employees sickened by asbestos exposure on the job. Â
Asbestos Trust Fund Claims
Many asbestos companies filed for bankruptcy in the face of mounting asbestos-exposure claims. The courts required them to establish asbestos trust funds to compensate asbestos-exposure victims. If one of these companies is responsible for a mesothelioma patient’s asbestos exposure, they can file a claim with the trust fund. Â
What Is the Statute of Limitations for Mesothelioma Claims in NC?
North Carolina’s statute of limitations for mesothelioma claims sets the deadline for filing an asbestos exposure lawsuit. In North Carolina, you have three years to file a personal injury suit related to mesothelioma and two years to file a wrongful death claim.

I grew up in Los Angeles, in Baldwin Hills, and spent my elementary years there. I ended up in junior high school in Gardena. In junior high, I took art class, where we worked with different mediums—drawing, painting, and ceramics. I did that for a year and a half.
I also went into auto shop when I entered high school. There, we were exposed to asbestos in the brake linings and the dust from the grinding of the brakes.
For me, I was fortunate to be diagnosed early on, and it was purely by chance. I had pain in my back, and they kept saying it might be a kidney stone or that I had lifted something heavy. After a year of pain, my primary care provider suggested, “Let’s get a CAT scan and see what’s going on.” They found a nodule and told me, “You’re fine. You’re young. There’s no way you could possibly have mesothelioma.”
I found a physician on the East Coast, and he ran his own tests. At the end of it, he confirmed I had mesothelioma. He knew my story and the problems I had with medical insurance, and he said, “I really think you’re going to need some compensation because you won’t be able to afford the surgery and treatment.”
Then I called Meirowitz & Wasserberg. They answered immediately, and I spoke with them. Daniel said, “I’ll do my best for you. I’ll treat you like family.” I felt that he was very genuine.
I knew how important it was—she had two young children and a husband. At first, we didn’t know how she had been exposed to asbestos. But we started to figure it out. We went through high school yearbooks and discovered that the students in the shop class at San Pedro High School had been using asbestos in the late ’70s. We filed the case and were able to sue the Los Angeles Unified School District.
LAUSD became the target because we found out that they knew about the hazards of asbestos and allowed students to work with it, which made Kim sick.
We secured $5 million for her because she trusted us. She worked with us, and we poured our heart and soul into the case. It wasn’t only me; I had a whole team of people supporting me.
What differentiates our firm from the competition is that we’re in the sweet spot. Our firm isn’t so large that clients feel like they’re just a number and don’t get personalized attention, but we’re big enough to have the resources to do everything a large firm can. We can hire the best experts, take on the biggest companies, and see a case all the way through trial.
Meirowitz & Wasserberg truly saved my life, emotionally and mentally—not just because of the support I received, but because they secured more than I ever expected. They ensured a future for my children, something I wouldn’t have been able to do. I knew they would be taken care of. They gave me the greatest gift.
