Statute of Limitations

In New Jersey, the statute of limitations governing most personal injury cases is set at two years from the date of injury. This simply means that injury victims must file their lawsuit seeking compensation within two years after they were injured. 

Sometimes, there may be an exception lengthening the time you have to file. In other cases, the deadline may actually be shortened. In all cases, the governing deadline is strictly enforced. New Jersey’s Modified Comparative Negligence Law

Another important law is the doctrine of comparative negligence. Compensation will be allocated accordingly. Further, anyone who contributed more than 50 percent to an accident is barred from receiving compensation. 

To illustrate, suppose you are involved in a car accident that leaves you with $1 million in damages. However, the jury in your case finds that your texting and driving contributed 20 percent to the cause of the accident. In this case, your compensation would be reduced to $800,000. However, if you contributed more than 50 percent, you cannot legally receive any compensation at all.
